David has practiced law in Indiana since his graduation from Indiana University's Maurer School of Law in 1981 and joined his father, brother and uncle at the firm. 

The Ferguson Law firm was recognized in 2018 for the Half Century Business Award by the Governor for its 62 years of service to the citizens of the State.  In 2022, the firm celebrated its 50th year at its current location in the Ferguson Building at 403 E. 6th St.

The majority of David's practice is currently based in central Indiana for government entities (schools, public housing, fire districts) and fire/EMS departments, cities and other clients for insurers.  David and his firm also have a real estate practice representing property management companies (landlord/tenant) and other clients (property ownership and construction disputes).  David and his firm also handle commercial disputes.  David has represented clients in State courts in many of the counties around the State of Indiana and in the federal courts of Indiana.  He has represented insurance companies and governmental entities in the defense of personal injury and property damage claims arising from automobile accidents, medical negligence claims (against EMT's and paramedics), and negligence claims against fire and police departments.  He has represented manufacturers and dealers of recreational vehicles, mobile homes, gas heaters, spray paints and golf carts, among other products, in defense of product liability cases and cases alleging personal injuries, property damage, defective product performance and other issues.  He has represented companies, individuals and families in disputes over real estate, company sales, and manufacturing contracts.  

David belongs to the American and Indiana State Bar Associations, the Monroe County Bar Association, National Council of School Attorneys, Indiana Council of School Attorneys, Defense Research Institute, and the Defense Trial Counsel of Indiana.  David is a life member of the Fellows of the Indiana Bar Foundation.  David has been rated by Super Lawyers as a Super Lawyer.  He is rated as AV by Martindale Hubbell, its highest rating in legal ability and ethical standards.

David is active in the community,  He previously served for fifteen years on the Monroe County Parks Board (mayor's appointment) and served on the Board of the Monroe County History Center and the board of Bloomington Restorations, a not-for-profit historic renovation group in Monroe County.

David recently completed his service on the Monroe County Library Board of 28 years, having been appointed for separate terms by both the County Commissioners and the County Council.  He currently serves on the Bloomington Chamber of Commerce Board.

David serves on the Acacia Fraternity Foundation, a national education foundation for the Acacia Fraternity.  David's family has been associated with the local chapter of Acacia for over 100 years since his grandfather was one of the founding members of the Indiana Chapter in 1920.  The Chapter House was recently named for the Ferguson family in recognition of its contributions over the years.

David's family was recognized in 2020 by the State of Indiana for the Hoosier Homestead Bicentennial Award in the 200th year of the family farm (1820, Lawrence County).

In his free time, David has participated in historic renovations of several downtown Bloomington buildings, creating housing opportunities and contributing to the vitality of the downtown.  David is a long-time member and supporter of Downtown Bloomington, a not-for-profit supporting Bloomington's downtown.

David enjoys a weekly game of recreational soccer with a group of friends.  David and his wife, Tyler Kate, enjoy travel, golf, working on their 1920's home and supporting their two cats in the lifestyle to which they have become accustomed (the cats, that is).
